Acceptance of Terms

By accessing our website, booking activities, or participating in water sports at Swacham Water Adventures, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Swacham Water Adventures ("we," "us," or "our"). Your continued use of our services signifies your acceptance of these terms and any updates or modifications.

Booking & Payment

Booking Process:

• Bookings can be made online, via phone, or in person at our facility
• All bookings are subject to availability and weather conditions
• We reserve the right to refuse service to anyone at our discretion
• Advance booking is recommended, especially during peak season

Payment Terms:

• Full payment is required at the time of booking for online reservations
• Walk-in customers must pay before participating in activities
• We accept cash, UPI, credit/debit cards, and digital wallets
• All prices are in Indian Rupees (INR) and include applicable taxes
• Prices are subject to change without prior notice

Confirmation:

You will receive a booking confirmation via email or SMS. Please present this confirmation (digital or printed) at our facility.

Cancellation & Refund Policy

Customer Cancellations:

• 24+ hours before: Full refund (100%)
• 12-24 hours before: 50% refund
• Less than 12 hours: No refund
• No-show: No refund

Weather Cancellations:

• We reserve the right to cancel activities due to adverse weather or unsafe conditions
• Full refund or rescheduling option provided for weather cancellations
• We monitor weather continuously and prioritize participant safety

Refund Processing:

Approved refunds will be processed within 7-10 business days to the original payment method.

Safety & Liability Waiver

Assumption of Risk:

Water sports activities involve inherent risks. By participating, you acknowledge that you understand these risks and voluntarily assume all risks of injury, death, or property damage.

Our Safety Commitment:

• All activities supervised by certified professionals
• Safety equipment provided (life jackets, helmets, etc.)
• Pre-activity safety briefings mandatory for all participants
• Regular equipment maintenance and safety inspections

Limitation of Liability:

To the fullest extent permitted by law, Swacham Water Adventures shall not be liable for any personal injury, death, or property damage arising from participation in our activities, except in cases of gross negligence or willful misconduct.

Insurance:

We maintain general liability insurance. However, participants are encouraged to have their own personal accident and medical insurance.

Participant Requirements

Age Requirements:

• Jet Ski: 18+ years (solo), 12+ years (with adult)
• Parasailing: 12+ years
• Speed Boat: All ages (with life jacket)
• Banana Boat: 8+ years
• Zorbing: 10+ years
• Minors (under 18) must have parental/guardian consent

Health & Fitness:

Participants must be in good health and free from conditions that may be aggravated by physical activity. You must disclose any medical conditions including but not limited to:

• Heart conditions or high blood pressure
• Respiratory problems (asthma, etc.)
• Back, neck, or joint problems
• Pregnancy
• Recent surgeries or injuries
• Seizures or epilepsy

Physical Requirements:

• Ability to swim (preferred but not mandatory with life jacket)
• Sufficient mobility to board/exit watercraft
• Weight limits may apply for certain activities (consult staff)

Prohibited:

• Participation under the influence of alcohol or drugs
• Concealing medical conditions from staff

Code of Conduct

All participants must:

• Follow all safety instructions and staff directions
• Wear provided safety equipment at all times
• Attend mandatory pre-activity safety briefings
• Treat staff, instructors, and other participants with respect
• Respect the marine environment and local wildlife
• Use equipment properly and report any defects immediately

Prohibited Behavior:

• Reckless or dangerous operation of watercraft
• Ignoring staff instructions or safety protocols
• Harassment, abuse, or threatening behavior
• Damage to equipment or facilities
• Littering or environmental damage

Consequences:

Violation of these rules may result in immediate termination of your activity without refund and potential ban from future services.

Intellectual Property

All content on our website and promotional materials, including text, graphics, logos, images, and software, is the property of Swacham Water Adventures and protected by copyright laws.

Photography & Video:

• We may photograph or video activities for promotional purposes
• By participating, you consent to being photographed/filmed
• You grant us the right to use such images in marketing materials
• If you do not wish to be photographed, please inform staff in advance

Restrictions:

You may not reproduce, distribute, or create derivative works from our content without written permission.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date.

Your continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

Notification:

Significant changes may be communicated via email to registered users or posted prominently on our website.

Additional Information

Governing Law:

These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Udupi, Karnataka.

Severability:

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.
